Terms of Service

1. Acceptance of Terms

By accessing or using CaptionLint ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and CaptionLint. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

CaptionLint is a web-based service that:

  • Processes SRT and VTT caption files
  • Fixes line breaks, pacing, and punctuation issues
  • Provides analytics on caption quality
  • Offers history tracking of previous fixes

The Service is provided "as is" and may include bugs or errors. We do not guarantee uninterrupted or error-free operation.

3. User Accounts

3.1 Account Creation

  • You must be at least 13 years old to create an account
  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use

3.2 Google OAuth

We use Google OAuth for authentication. By using our Service, you agree to Google's Terms of Service and Privacy Policy.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. Usage Limits and Fees

4.1 Free Tier

CaptionLint offers a free tier with usage limits:

  • Currently: 30 fixes per rolling 30-day window
  • Limits are subject to change at any time
  • We will notify users of significant limit changes

4.2 Future Paid Plans

We may introduce paid plans with additional features or higher usage limits. Fees and terms will be clearly disclosed before you commit to any paid service.

4.3 Fair Use

You agree not to:

  • Use automated scripts to abuse the Service
  • Share accounts or exceed usage limits through circumvention
  • Use the Service for commercial purposes beyond reasonable personal use

5. User Content and Data

5.1 Caption Files

You retain all rights to caption files you upload to our Service. Your files are processed in memory and not stored on our servers.

5.2 User Responsibilities

You are solely responsible for:

  • Ensuring you have the right to process caption files
  • Complying with all applicable laws and regulations
  • The accuracy and quality of your content

5.3 History Data

We store your fix history for up to 30 days to provide the History feature and calculate usage limits. You can delete individual history items or your entire account at any time.

6. Intellectual Property

6.1 Our Intellectual Property

CaptionLint and all related content, features, and functionality are owned by CaptionLint and are protected by copyright, trademark, and other intellectual property laws.

6.2 Your License to Use

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal purposes in accordance with these Terms.

6.3 Restrictions

You may not:

  • Copy, modify, or distribute the Service
  • Reverse engineer or attempt to extract source code
  • Use the Service to build competing products
  • Remove or alter any proprietary notices

7. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

By using CaptionLint, you consent to our data practices as described in the Privacy Policy.

8. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF RESULTS
  • UNINTERRUPTED OR ERROR-FREE OPERATION

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPTIONLINT SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
  • DAMAGE TO YOUR COMPUTER OR SOFTWARE
  • ERRORS OR INACCURACIES IN CAPTION FIXING RESULTS
  • ANY DAMAGES EXCEEDING THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above exclusions may not apply to you.

10. Termination

10.1 Termination by You

You may stop using the Service at any time. You may also delete your account, which will result in permanent loss of your data and history.

10.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, for:

  • Violation of these Terms
  • Suspicious or fraudulent activity
  • Technical or security issues
  • Discontinuation of the Service

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will delete your account data within a reasonable time frame, except where required by law to retain it.

11. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where CaptionLint is based.

12. Indemnification

You agree to indemnify and hold harmless CaptionLint from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload or process through the Service

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website.

Your continued use of the Service after changes constitutes acceptance of the new Terms. We will make reasonable efforts to notify users of significant changes via email or in-app notifications.

14. Miscellaneous

  • These Terms constitute the entire agreement between you and CaptionLint
  • If any provision is found unenforceable, the remaining provisions remain in full force
  • Our failure to enforce any right does not constitute a waiver
  • You may not transfer or assign these Terms without our consent
  • We may assign these Terms without restriction
